Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lupafina website, web application, and related services at https://lupafina.com/ (the "Service"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service, unless local law allows a younger person to use the Service with the consent of a parent or legal guardian, if required.

The Service is intended to be family friendly, but it is not intended for use by children where local law does not permit that use.

2. Accounts

To use certain features, you may need to create an account.

You agree to:

  • provide accurate information;
  • keep your credentials secure;
  • notify us if you suspect unauthorized access;
  • be responsible for activity under your account.

You may sign up using email/password or third-party login providers such as Google.

3. The Service

Lupafina is a personal finance organization and tracking tool that allows users to record, organize, and analyze information such as income, expenses, savings, balances, and financial goals.

We may add, remove, or modify features over time.

4. Financial information and user responsibility

You are responsible for the accuracy of the data you enter into the Service.

Lupafina does not verify that your financial records, categories, balances, goals, assumptions, imported data, or AI inputs are complete, current, or accurate.

You should independently review all information before relying on it.

5. No financial, investment, tax, or legal advice

The Service is provided for informational, organizational, and budgeting purposes only.

Lupafina does not provide financial planning, investment advice, tax advice, legal advice, credit counseling, or any regulated professional service.

Any calculations, projections, summaries, alerts, or AI-generated suggestions are informational only and may contain errors. They should not be relied on as professional advice.

You are solely responsible for reviewing and deciding whether to rely on any output from the Service.

6. AI features and third-party processing

The Service may use third-party AI or machine learning tools to analyze user content and generate outputs.

You agree that we may process, store, and share your content with those providers as necessary to operate the Service, generate AI outputs, maintain security, and improve the Service and related models, subject to the Privacy Policy and any applicable consent settings.

You understand and agree that:

  • AI-generated outputs may be inaccurate, incomplete, delayed, or inappropriate for your situation;
  • AI outputs are not financial, legal, tax, accounting, investment, or other professional advice;
  • you should review AI outputs before relying on them;
  • we may use de-identified, aggregated, or otherwise protected data to improve the Service and our AI systems where permitted by law and consistent with the Privacy Policy.

7. Acceptable use

You agree not to:

  • use the Service unlawfully;
  • interfere with or disrupt the Service;
  • attempt unauthorized access to systems or accounts;
  • upload malicious code;
  • scrape, reverse engineer, or misuse the Service except as permitted by law;
  • use the Service to infringe others’ rights.

8. User content

You retain ownership of the data and content you submit to the Service.

You grant Lupafina a limited, non-exclusive license to host, store, process, reproduce, display, analyze, and create derivative outputs from your content solely as necessary to operate, improve, secure, support, and develop the Service, including AI features, in line with the Privacy Policy and any applicable consent.

9. Intellectual property

The Service, including its software, design, branding, text, graphics, and other content provided by Lupafina, is owned by or licensed to Lupafina and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from the Service except as allowed by law or with our written permission.

10. Availability and changes

We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with all devices.

We may suspend or change features at any time.

We are not responsible for interruptions or issues caused by third-party service providers, hosting platforms, infrastructure, or integrations outside our reasonable control.

11. Future paid plans

Some features may become paid in the future. If we introduce subscriptions or paid plans, we will provide additional pricing, billing, renewal, and cancellation terms at that time.

12. Termination

You may stop using the Service at any time. You may also request account deletion through the Service or by contacting us.

We may suspend or terminate access if you violate these Terms, create risk for the Service or other users, or where legally required.

If your account is deleted, we may retain certain information for a limited period where needed for legal compliance, security, fraud prevention, dispute resolution, backup integrity, or legitimate business purposes.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will meet your expectations or produce specific financial outcomes.

Nothing in these Terms limits any warranty or liability that cannot be excluded under applicable law.

14. Limitation of liability

To the maximum extent permitted by law, Lupafina will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, use, or data.

To the maximum extent permitted by law, Lupafina’s total liability arising out of or relating to the Service will not exceed the greater of:

  • the amount you paid to Lupafina for the Service in the 12 months before the event giving rise to the claim; or
  • USD 100, if you have not paid anything.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Lupafina from claims, liabilities, damages, losses, and expenses arising out of your misuse of the Service, your content, or your violation of these Terms, to the extent permitted by law.

16. Governing law

These Terms are governed by the laws of the Oriental Republic of Uruguay, without regard to conflict-of-law principles, unless mandatory consumer law in your jurisdiction requires otherwise.

17. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.

If a change is material, we may provide additional notice where required by law or where we reasonably consider it appropriate.
